- These terms and conditions represent a contractual relationship between you and Tamek General Trading and Contracting Company (W.L.L.), which owns the website http://Walawme.com  

- This Agreement sets forth the terms and conditions under which you are permitted to use the website http://Walawme.com (hereinafter referred to as Walaw), and to access the website to use the services, you agree to all the terms set forth in this Agreement (Terms and Conditions of Use), as well as the provisions contained in the Privacy Policy and any other provisions posted on the Website whether generally related to this Agreement or limited to a specific service, all of them are considered an integral part of this Agreement. You are also responsible for ensuring that all people who access the site through your internet connection are aware of the terms of this site and comply with them. By viewing, browsing, using, or accessing the site or submitting any contents or materials to the site, you agree to these terms of use as a binding legal Agreement between you and (Walaw) website without any restriction or condition. The term "You" shall refer to any person or entity,  that displays, uses, accesses or browses the Site. IF YOU DO NOT AGREE TO THESE TERMS OF USE, YOU MAY NOT USE THE SITE, and Walaw platform website will reserve the right to amend these Terms of Use at any time and without prior notice, and you agree that every visit you make to the websites will be subject to the Terms of Use in force at that time, and that continuing to use the website now or after amendments to these terms of use CONFIRMS THAT YOU HAVE READ AND AGREED TO BE BOUND BY THESE AMENDMENTS. These terms and conditions are applied to the website (Walaw platform) and all its electronic applications.

 
The terms and conditions are published in accordance with the provisions of the law of the State of Kuwait.

1- Definitions:
The following definitions shall have the meanings ascribed thereto, unless these terms and conditions expressly state otherwise or what require the drafting of the text:
-    Walaw platform is an electronic platform (http: // Walawme.com.) Owned by Tamak General Trading and Contracting Company (W.L.L.), which enables users to benefit from the services provided by the site. And/or application. The website and affiliate applications called (electronic platform).
-    Services: Walaw platform provides the services of sending gifts or their value in cash from the customer to the recipient.
-    Agreement: These Terms and Conditions. 
-    Client/ customer: the sender of the gift to the recipient.
-     Recipient: the person who is given the gift, it is the Party specified by the customer to receive the gift sent or receive its value in cash after deducting the fees.
-     User: Anyone who registers on Walaw platform to benefit from the services.
-    Privacy Policy: The provisions regarding the validity of the use of data for customers or users, which are subject to the provisions contained therein, which are an integral part of the provisions mentioned in this Agreement.
-    Usage: Browsing the electronic platform and use the services provided through it.
-     Registration: Create an account on Walaw platform through the user to benefit from the services provided.
-     The company/companies are the companies from which gifts and products are to be purchased by the customer.

2- The purpose:
The purpose of this Agreement is to set out the terms and conditions on which Walaw platform permits the user to access the site to enjoy the services provided.

3- Walaw platform site
-    "Walaw platform" is an electronic (intermediary) platform between customers (users) and gifted users (the recipients) and the companies. It provides services option for delivering and preparing gifts or replacing the value of gifts in cash. 

4- License:
-     (Walaw platform) authorizes you to access the site with a non-transferable, non-exclusive license which is revocable. It makes the site available to you during the validity of this Agreement and for the purpose stipulated only. (Walaw platform) from time to time may update, modify the site and add or cancel services. and you may not license or assign others to any of the rights granted to you in accordance with this Agreement, especially authorizing others to access the site using your account.  

5- Registration on the site:
By using (Walaw platform) and/or registration and/or continuing to browse the site, you agree to the Terms and Conditions and Privacy Policy. and you acknowledge that your age is not less than 18 years, and that you are responsible for the activities you do, and that you are fully eligible.

The data provided by you in the registration form must be correct and accurate, and we are entitled not to fulfill any of the services and limit your use of the website or prevent using it when abuse or when there is a doubt that the user provides incorrect data or without giving any reasons.

6-Services provided:
-    The Agreement between the customer and (Walaw) is a Service Agreement regarding providing technical solutions to facilitate the provision of the option for the gifts type for the recipients or the granted.
-    (Walaw) is not responsible for the nature or quality of the presented gifts and its role is limited to the following: 
-    (Walaw) provides you with a service of preparing and delivering gifts to the recipient or replacing the value of gifts in cash.
-    The recipient is contacted on behalf of the customer, to give it the options of receiving the gift or replacing its value in cash, and in the event that the recipient chooses the gift, it is delivered according to the registered address, and in the event of exchange for cash, the service fee is deducted, and the remaining amount is transferred to the recipient account via a bank link sent from the recipient to (Walaw) customer service so that they can transfer through the link in order to preserve the data and privacy of the recipients.
-    If the gift chosen by the customer is not available, the available option for the recipient is only the cash option.
-    Delivery times through the platform are chosen by the recipients, as well as the identification of the delivery addresses.

7- How to order from the website:
-    The user must register the entry data fully, correctly, and accurately  according to the application forms to provide the services with the desired quality.
-    After the registration process is completed, a special account is created for each user which can only be used through a (secret) password chosen by the user.
-    Notifying us of the proposed gift and the required processing and adding the recipient data, and then " place the order ". Please note that it is important that you review the information you enter and correct any errors before clicking on the "Place Order" button. Because once you click on the "Place Order" option, errors cannot be corrected. Upon receiving your order, we will begin processing the order at (Walaw) to fulfil the order and send you a message stating that your order has been successfully received, including the fees. 
-    Once your order is received, we do at walaw  communicate with the recipient (the granted) via text messages, and inform him of the details of the gift and the name of the sender, and notify him of the existence of an option to receive the value of the gift in cash, and in the event of the selection of the gift, the delivery date and the address will be determined through the platform and by the recipient choice, and in the case of choosing the value of the gift, the amount will be transferred to the recipient after deducting the value of the fees.
-    When choosing the financial value of the gift, the payment is made through a link sent by the recipient to Walaw team.
-    If the recipient is late in responding, the amount will be returned to the customer after deducting the fees.

8- Cancellation and Refund:
-    The service fees are non-refundable.
-    The orders that take place through the website cannot be canceled after being confirmed by the Customer and/or the Recipient.
-    The platform (Walaw) can cancel your order without giving any reasons, in which case the customer is entitled to a full refund. 
-    If a wrong product is delivered, please contact our customer service team with photos of your order within (6) hours of delivery. We will provide an alternative as soon as possible.

9-Terms of use of services:
-    The mere use of the services that we provide on the platform (Walaw), means that you agree and acknowledge the following:
-    Using the services personally, and not reuse them or pass them on to any other party.
-    Not to copy or distribute any of the contents of the services and the technical or non-technical materials contained therein.
-    The decision of the recipient (the granted) whether to accept or refuse to receive the gift is confidential and will not be disclosed to any party, especially the customer.
-    Not to use the services for any purpose that contradicts or violates any of the laws, regulations, public order, and morals.
-    Not to register on behalf of third parties (unless you are a guardian of children) or impersonate other people.
-    You must ensure that no unauthorized person uses your mobile phone or uses your personal account with a password, and in the event of suspicion that your application account or password has been stolen , you must notify us immediately through the available contact information.
-    We at (Walaw) reserve the right to terminate your use of any of the services, if you do not comply with any of the aforementioned rules.

10- Payment of fees:
-    Registration on the platform is free of charge.
-    The customer shall pay the full-service fees and delivery fees in favor of the platform (Walaw), and it is non-refundable, in the amount of KD (6) only, for each order through the website.  
-     If the recipient chooses the amount of money, the platform (Walaw) is entitled to obtain a percentage of the value of the gift only without delivery fees according to the schedule shown to the customer before executing the order and  paying an amount for the service.

11- Intellectual property rights:
-    The platform (Walaw) owns all the rights to the applications and the website, including intellectual property rights and subsidiary and related rights, as well as any ideas, techniques, improvements, requests to improve the service, opinions and recommendations, or any information provided by the user, or any other party linked to the Services and related materials. Any modification, copying, revision, translation, or any derivative or related works of the Services, shall be done only and exclusively by (Walaw), or through authorized bodies, (as the case may be) as well as any patents, copyrights, and trademark rights.
-    The name of the company (Tamic General Trading and Contracting Company (W.L.L.) that owns the platform, its logo, and the names of the services and logos associated with them represent trademarks owned by the company and its allies or other parties (as the case may be), and the use of these marks by third parties is not permitted unless there is an agreement between the Company and any third party.

12-Disclaimer:
-    We at (walaw) do not bear any responsibility that may result from the customer entering false, incomplete, or contrary to reality data.
-    We at (walaw) or its technology service providers do not guarantee that there will be no errors, omissions, delays, interruptions, or losses (including data loss). The platform shall not be liable for any direct or indirect losses or damages that may arise from the use or inability to use the platform, application, or website. The user will download and operate the services at its own risk and under its own care, and it is the only one responsible for any malfunctions or loss of data from its mobile phone or electronic devices, when downloading or operating any of our services.
-    The website does not guarantee in any way that the files you wish to download are free of viruses or harmful files, and you must verify the integrity of any files before downloading them.
-    (Walaw) does not make any express or implied warranties of any kind, nor does it make any warranties or representations that the services will be uninterrupted, or that the services will be available at a time convenient to you, or that they are completely secure and free from any technical errors. The website reserves the exclusive right to temporarily or permanently, with or without notice, modify or discontinue any of the Services or any part of the Services, at any time and from time to time..
-    You agree that (walaw) will not to be liable to you or to any third party for any modifications, suspension, or discontinuance of any or part of the Services.

13- Data privacy:
Your use of our Services is subject to the Privacy Policy to protect your personal data and information. So please review the Terms and Conditions of the Privacy Policy to see how your data is used, secured, and published.

14-User Responsibilities:
The user is responsible for: 1) All information and data that he places on the website. 2) The accuracy and validity of this information. 3) Respect all applicable laws, regulations and procedures. 4) Keep passwords and access codes to the website, and refrain from sharing them with any third party.

15-Termination:
We reserve the right to immediately terminate your use of the website (in our sole discretion) if you breach the terms and conditions of this Agreement or if you commit any act of fraud, deception, or violation of (walaw) applicable policies. Upon termination of your use for any reason, you will no longer be permitted to access the Website, in addition to the right of "Walaw" to take other measures to redress the damage and (Walaw) will not be responsible for the return of any information or data stored after termination of use for any reason.

16- Confidentiality and non-disclosure:
All customer, recipient and order information and data shall remain confidential and shall not be disclosed to any third party unless otherwise required by law.
All information announced by the platform (Walaw) is confidential information, and it is not used for any other purpose except within the limits of the purposes stipulated in this Agreement, which is the use of the platform services, and this information may not be disclosed to any third party unless required by law. 

17- Applicable Law:
These terms and conditions, their interpretation and application, and any disputes arising therefrom, shall be governed by the laws of the State of Kuwait, and the courts of the State of Kuwait shall be competent to consider any dispute that may arise regarding their interpretation, application, or implementation.

18- Severability 
If any provision or part of a provision of these Terms and Conditions is found to be prohibited by law, or if a court decides that it is void or unenforceable, then that provision or the relevant part of these Terms and Conditions will be severed, while the rest of the Terms remain valid.

19- Force Majeure:
(Walaw) will not be responsible for the non-performance of any or part of its obligations or the delay in it if this is due to a cause of force majeure that is beyond its control.
